Article 259 of the French Customs Code

In the event of exceptional events having the effect of temporarily interrupting maritime relations reserved for ships operated by shipowners who are nationals of a Member State of the European Community or of a State party to the Agreement on the European Economic Area, registered in a Member State of the European Community or in another State party to the Agreement on the European Economic Area and flying the flag of that same State, the Government may suspend the application of article 257 by decree deliberated in the Council of Ministers after consultation with the Council of State, and for as long as the suspension lasts, and thus authorise ships flying the flag of a State other than those mentioned above to carry out transport between ports in mainland France.

The return to the normal regime is pronounced in the same form as soon as circumstances allow.

Article 259

En cas d’événements exceptionnels ayant pour effet d’interrompre temporairement les relations maritimes réservées aux navires exploités par des armateurs ressortissants d’un Etat membre de la Communauté européenne ou d’un Etat partie à l’accord sur l’Espace économique européen, immatriculés dans un Etat membre de la Communauté européenne ou dans un autre Etat partie à l’accord sur l’Espace économique européen et battant pavillon de ce même Etat, le Gouvernement peut suspendre par décret délibéré en conseil des ministres après avis du Conseil d’Etat, et pendant tout le temps que dure cette interruption, l’application de l’article 257 et autoriser ainsi les navires battant pavillon d’un Etat autre que ceux précités à effectuer des transports entre les ports de la France métropolitaine.

Le retour au régime normal est prononcé dans la même forme aussitôt que les circonstances le permettent.
