Article 361-1 of the French Code of Criminal Procedure

If, when the provisions of Article 349-1, the Assize Court has answered the first question in the affirmative and the second in the negative, it finds the accused guilty. If it has answered negatively to the first question or positively to the second question, it shall find the accused not guilty.

If it has answered in the affirmative to the first question and in the affirmative to the second question relating to the application of the provisions of the first paragraph of Article 122-1 of the Criminal Code, Articles 706-129 et seq. relating to declarations of lack of criminal responsibility on grounds of mental disorder shall be applied.

If the Assize Court has answered in the affirmative to the first question and in the negative to the second question relating to the application of the first paragraph of article 122-1 of the Criminal Code, the question of the application of the second paragraph of that same article must be raised.

Article 361-1

Si, lorsqu’il est fait application des dispositions de l’article 349-1, la cour d’assises a répondu positivement à la première question et négativement à la seconde question, elle déclare l’accusé coupable. Si elle a répondu négativement à la première question ou positivement à la seconde question, elle déclare l’accusé non coupable.

Si elle a répondu positivement à la première question et positivement à la seconde question portant sur l’application des dispositions du premier alinéa de l’article 122-1 du code pénal, il est fait application des articles 706-129 et suivants relatifs à la déclaration d’irresponsabilité pénale pour cause de trouble mental.

Si la cour d’assises a répondu positivement à la première question et négativement à la seconde question portant sur l’application du premier alinéa de l’article 122-1 du code pénal, doit être posée la question de l’application du second alinéa de ce même article.
