Article 363 of the French Code of Criminal Procedure

If the fact held against the accused does not fall or no longer falls under the application of criminal law, or if the accused is found not guilty, the assize court pronounces the accused acquitted.

If the accused benefits from a cause for exemption from punishment, the assize court finds him guilty and exempts him from punishment.

Si le fait retenu contre l’accusé ne tombe pas ou ne tombe plus sous l’application de la loi pénale, ou si l’accusé est déclaré non coupable, la cour d’assises prononce l’acquittement de celui-ci.

Si l’accusé bénéficie d’une cause d’exemption de peine, la cour d’assises le déclare coupable et l’exempte de peine.
