Article 391 of the French Civil Code

In the case of legal administration, the guardianship judge may, at any time and for serious cause, either ex officio or at the request of relatives or allies or the public prosecutor, decide to open guardianship after hearing or calling, except in an emergency, the legal administrator. The latter may not carry out any act of disposal from the time of the application until the final judgment except in an emergency.

If guardianship is opened, the guardianship judge convenes the family council, which may either appoint the legal administrator as guardian or appoint another guardian.

Article 391

En cas d’administration légale, le juge des tutelles peut, à tout moment et pour cause grave, soit d’office, soit à la requête de parents ou alliés ou du ministère public, décider d’ouvrir la tutelle après avoir entendu ou appelé, sauf urgence, l’administrateur légal. Celui-ci ne peut faire aucun acte de disposition à partir de la demande et jusqu’au jugement définitif sauf en cas d’urgence.

Si la tutelle est ouverte, le juge des tutelles convoque le conseil de famille, qui peut soit nommer comme tuteur l’administrateur légal, soit désigner un autre tuteur.
