In all the cases provided for in this paragraph 3, the court may, at the request of the parties or of its own motion, assign by judgment one of its members or one of the investigating judges of the court appointed under the conditions of the first paragraph of Article 83, to proceed with additional information; the provisions of Article 463 shall apply.
The court may, under the same conditions, if it considers that the complexity of the case requires further in-depth investigations, refer the case to the public prosecutor.
The court will first decide whether to keep the accused in pre-trial detention until he or she appears before an investigating judge. This appearance must take place on the same day, failing which the accused is automatically released. However, if the seriousness or complexity of the case justifies the court assigning a judge from the competent investigating division and there is no division within the judicial court, this appearance must take place before the investigating judge of the territorially competent division within five working days, failing which the accused shall be released automatically.
