Article 403 of the French Civil Code

The individual right to choose a guardian, whether related to the minor or not, belongs only to the last surviving father and mother if he or she has retained, on the day of death, the exercise of parental authority.

This appointment may only be made in the form of a will or a special declaration before a notary.

It is binding on the family council unless the interests of the minor require it to be set aside.

The tutor appointed by the father or mother is not obliged to accept guardianship.

Le droit individuel de choisir un tuteur, qu’il soit ou non parent du mineur, n’appartient qu’au dernier vivant des père et mère s’il a conservé, au jour de son décès, l’exercice de l’autorité parentale.

Cette désignation ne peut être faite que dans la forme d’un testament ou d’une déclaration spéciale devant notaire.

Elle s’impose au conseil de famille à moins que l’intérêt du mineur commande de l’écarter.

Le tuteur désigné par le père ou la mère n’est pas tenu d’accepter la tutelle.
