Article 410 of the French Civil Code

The subrogated guardian supervises the exercise of the guardianship mission and represents the minor when the minor’s interests are in opposition to those of the guardian.

The subrogated guardian is informed and consulted before any important act is carried out by the guardian.

On pain of incurring liability to the minor, he supervises the acts performed by the tutor in that capacity and informs the guardianship judge without delay if he finds any faults in the exercise of the tutelary mission.

He does not automatically replace the tutor in the event of the latter’s cessation of duties; but he is required, under the same responsibility, to bring about the appointment of a new tutor.

Le subrogé tuteur surveille l’exercice de la mission tutélaire et représente le mineur lorsque les intérêts de celui-ci sont en opposition avec ceux du tuteur.

Le subrogé tuteur est informé et consulté avant tout acte important accompli par le tuteur.

A peine d’engager sa responsabilité à l’égard du mineur, il surveille les actes passés par le tuteur en cette qualité et informe sans délai le juge des tutelles s’il constate des fautes dans l’exercice de la mission tutélaire.

Il ne remplace pas de plein droit le tuteur en cas de cessation des fonctions de celui-ci ; mais il est tenu, sous la même responsabilité, de provoquer la nomination d’un nouveau tuteur.
