Article 431 of the French Customs Code

In addition to the fine incurred for refusal to disclose under the conditions set out in articles 65 and 65d, offenders must be ordered to produce the books, documents or records that have not been disclosed, subject to a penalty of at least €150 for each day of delay.

This penalty begins to run from the day on which the parties sign or are notified of the official report drawn up to record the refusal to comply with the judgment duly served; it only ceases to run from the day on which it is recorded, by means of a note made by an inspection officer on one of the company’s or establishment’s main books, that the administration has been able to obtain the disclosure ordered.

Indépendamment de l’amende encourue pour refus de communication dans les conditions prévues aux articles 65 et 65 quinquies, les contrevenants doivent être condamnés à représenter les livres, pièces ou documents non communiqués, sous une astreinte de 150 € au minimum par chaque jour de retard.

Cette astreinte commence à courir du jour même de la signature par les parties ou de la notification du procès-verbal dressé pour constater le refus d’exécuter le jugement régulièrement signifié ; elle ne cesse que du jour où il est constaté, au moyen d’une mention inscrite par un agent de contrôle sur un des principaux livres de la société ou de l’établissement, que l’administration a été mise à même d’obtenir la communication ordonnée.
