Article 470-2 of the French Code of Criminal Procedure

The criminal court may not acquit the accused on the basis of one of the grounds of lack of criminal responsibility provided for by articles 122-2,122-3,122-4,122-5 and 122-7 of the Penal Code only after finding that the person had committed the acts of which they were accused.

If it considers that the first paragraph of Article 122-1 of the Criminal Code is applicable, it shall rule in accordance with Article 706-133 relating to the declaration of lack of criminal responsibility on grounds of mental disorder.

Le tribunal correctionnel ne peut relaxer le prévenu en raison d’une des causes d’irresponsabilité pénale prévues par les articles 122-2,122-3,122-4,122-5 et 122-7 du code pénal qu’après avoir constaté que celui-ci avait commis les faits qui lui étaient reprochés.

Dans le cas où il estime qu’est applicable le premier alinéa de l’article 122-1 du code pénal, il statue conformément à l’article 706-133 relatif à la déclaration d’irresponsabilité pénale pour cause de trouble mental.
