Article 61 bis of the French Customs Code

Pending the prohibition or authorisation decision referred to in Article 6 of Council Regulation (EC) No 428/2009 of 5 May 2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items, customs officers shall immobilise, under conditions laid down by decree in the Council of State, non-Community civilian and military dual-use items bound for a country that is not a member of the European Union, as well as their means of transport, at the expense of the owner, consignee, exporter or, failing this, any person involved in the transit operation.

Article 61 bis

Dans l’attente de la décision d’interdiction ou d’autorisation visée à l’article 6 du règlement (CE) n° 428/2009 du Conseil, du 5 mai 2009, instituant un régime communautaire de contrôle des exportations, des transferts, du courtage et du transit des biens à double usage, les agents des douanes immobilisent, dans des conditions fixées par décret en Conseil d’Etat, les biens à double usage civil et militaire non communautaires, à destination d’un pays non membre de l’Union européenne, ainsi que leurs moyens de transport, aux frais du propriétaire, du destinataire, de l’exportateur ou, à défaut, de toute personne qui participe à l’opération de transit.
