Article 67 D-3 of the French Customs Code

The following do not give rise to a prior exchange of views:

1° Decisions leading to the notification of offences provided for in this Code and decisions to carry out the checks provided for in Chapter IV of this Title;

2° Collection notices served in accordance with Article 345 for the purpose of recovering unpaid debts when due, with the exception of those established following an offence under this Code;

3° Measures taken in application of either a court decision or a collection notice served in accordance with the same Article 345.

Article 67 D-3

Ne donnent pas lieu à un échange contradictoire préalable :

1° Les décisions conduisant à la notification d’infractions prévues par le présent code et les décisions de procéder aux contrôles prévus au chapitre IV du présent titre ;

2° Les avis de mise en recouvrement notifiés conformément à l’article 345 aux fins de recouvrement des créances impayées à l’échéance, à l’exception de celles qui ont été constatées à la suite d’une infraction au présent code ;

3° Les mesures prises en application soit d’une décision de justice, soit d’un avis de mise en recouvrement notifié conformément au même article 345.
