Article 698-7 of the French Code of Criminal Procedure

The provisions of Article 698-6 are applicable, for the trial of ordinary crimes committed in the performance of service by military personnel, only if there is a risk of disclosure of a national defence secret.

When an indictment is issued pursuant to the first paragraph of Article 214, the Investigating Chamber shall state in its judgment, if applicable, that there is a risk of disclosure of a national defence secret and order that the Assize Court to which the case is referred be composed in accordance with the provisions of Article 698-6.

Les dispositions de l’article 698-6 ne sont applicables, pour le jugement des crimes de droit commun commis dans l’exécution du service par les militaires, que s’il existe un risque de divulgation d’un secret de la défense nationale.

Lorsque la mise en accusation est prononcée en application de l’article 214, premier alinéa, la chambre de l’instruction constate dans son arrêt, s’il y a lieu, qu’il existe un risque de divulgation d’un secret de la défense nationale et ordonne que la cour d’assises saisie soit composée conformément aux dispositions de l’article 698-6.
