The duties of specialist assistant for the prevention of acts of terrorism with the public prosecutor’s office may be carried out by category A or B civil servants as well as persons holding, in subjects defined by decree, a national diploma attesting to training of at least four years’ duration in higher education after the baccalaureate who meet the conditions for access to the civil service and can provide proof of at least four years’ professional experience.
Specialised assistants for the prevention of acts of terrorism undergo compulsory training before taking up their duties.
They participate in proceedings under the responsibility of the magistrates of the public prosecutor’s office, without however being able to receive delegated signing authority, except for the requisitions provided for in articles 60-1,60-2,77-1-1and 77-1-2.
They carry out all tasks entrusted to them by these magistrates and may in particular:
<1° Assist them in the conduct of public proceedings and in the preventive missions entrusted to them by law;
2° Provide magistrates with summary or analytical documents that may be added to the case file;
3° Implement the right of communication granted to magistrates pursuant to the article 132-22 du code pénal.
The public prosecutor may ask them to assist the public prosecutor before the appeal court.
They have access to the case file for the performance of the tasks entrusted to them and are subject to professional secrecy under the penalties provided for in article 226-13 of the same code.
The procedures for applying this article are those adopted pursuant to the last paragraph of article 706 of this code.
