Article 712-3 of the French Cinema and Moving Image Code

To be eligible for additional support, works must meet the following conditions:
1° They must be co-produced by at least three companies, one of which is established in France and two of which are established in States located in the African, Caribbean and Pacific zone. For the application of this section, States located in the African, Caribbean and Pacific zone are considered to be those mentioned in the list annexed to this book.
If the work is co-produced by more than three production companies, the number of companies established in States located in the African, Caribbean and Pacific zone is greater than or equal to the number of companies established in States not located in this zone.
Companies having their registered office in one of these States are deemed to be established in States located in the African, Caribbean and Pacific zone.
The companies involved in the co-production do not have links between themselves that would constitute control and are not controlled by the same natural or legal persons. The persons holding the position of chairman, director, manager or member of a management body must be different within each of the companies involved in the co-production;
2° The director is a national of a State located in the African, Caribbean and Pacific zone.

Article 712-3

Pour être éligibles aux aides complémentaires, les œuvres répondent aux conditions suivantes :
1° Elles font l’objet d’une coproduction entre au moins trois entreprises, dont une est établie en France et deux sont établies dans des Etats situés dans la zone Afrique, Caraïbes et Pacifique. Pour l’application de la présente section, sont considérés comme Etats situés dans la zone Afrique, Caraïbes et Pacifique les Etats mentionnés dans la liste figurant en annexe du présent livre.
Dans le cas où l’œuvre est coproduite par plus de trois entreprises de production, le nombre d’entreprises établies dans des Etats situés dans la zone Afrique, Caraïbes et Pacifique est supérieur ou égal au nombre d’entreprises établies dans des Etats qui n’y sont pas situés.
Sont réputées établies dans des Etats situés dans la zone Afrique, Caraïbes et Pacifique les entreprises ayant leur siège social dans l’un de ces Etats.
Les entreprises parties à la coproduction n’entretiennent pas entre elles de liens caractérisant un contrôle et ne sont pas contrôlées par les mêmes personnes physiques ou morales. Les personnes ayant la qualité de président, directeur, gérant ou membre d’un organe de direction doivent être différentes au sein de chacune des entreprises parties à la coproduction ;
2° Le réalisateur est ressortissant d’un Etat situé dans la zone Afrique, Caraïbes et Pacifique.
