In the event of non-compliance by the sentenced person with the obligations and prohibitions imposed, the sentence enforcement judge may, in accordance with the procedures laid down by article 712-6, withdraw all or part of the sentence reductions from which he or she has benefited and order his or her re-incarceration. The provisions of Article 712-17 shall apply.
The sentence enforcement judge warns the sentenced person that the measures provided for in articles 131-36-4 and 131-36-12 of the Penal Code may not be implemented without his consent, but that, failing this, all or part of the duration of the reductions in sentence from which he has benefited may, pursuant to the first paragraph, be withdrawn from him.
The decision provided for in the first paragraph may also be taken, after the opinion of the sentence enforcement judge, by the trial court if the person placed under judicial supervision is convicted of a felony or misdemeanour for which socio-judicial supervision is incurred.
If the convicted person refuses to start or continue the treatment prescribed by the doctor treating him or her and offered as part of a treatment order, this constitutes a breach of the obligations imposed on him or her.
