When the Minister of Justice cannot guarantee that the sentenced person will not be prosecuted, detained or subjected to any other restriction of his or her personal freedom on French territory, for acts or convictions prior to his or her departure from the territory of the sentencing State, he or she shall inform the authority that requested transit.
Lorsque le ministre de la justice ne peut garantir que la personne condamnée ne sera ni poursuivie, ni détenue, ni soumise à aucune autre restriction de sa liberté individuelle sur le territoire français, pour des faits ou condamnations antérieurs à son départ du territoire de l’Etat de condamnation, il en informe l’autorité qui a demandé le transit.
