Article 744 of the French Code of Criminal Procedure

If the convicted offender complies with the supervision and assistance measures and the special obligations imposed pursuant to article 739 and if his rehabilitation appears to be complete, the enforcement judge may declare the conviction against him null and void. The sentence enforcement judge may not be seized for this purpose or be seized of his own motion before the expiry of a period of one year from the day on which the sentence became final.

The decision is taken in accordance with the provisions of article 712-6.

Si le condamné satisfait aux mesures de contrôle et d’aide et aux obligations particulières imposées en application de l’article 739 et si son reclassement paraît acquis, le juge de l’application des peines peut déclarer non avenue la condamnation prononcée à son encontre. Le juge de l’application des peines ne peut être saisi à cette fin ou se saisir d’office avant l’expiration d’un délai d’un an à compter du jour où la condamnation est devenue définitive.

La décision est prise conformément aux dispositions de l’article 712-6.
