Article 745 of the French Code of Criminal Procedure

Where the person sentenced to a term of imprisonment suspended on probation must comply with the obligation to refrain from appearing in a specially designated place or area, in order to avoid contact with the victim or the civil party, or the obligation to refrain from entering into contact with the victim or the civil party, provided for in 9°, 13° and 18°bis of the Article 132-45 of the Penal Code, the sentence enforcement judge or the prison integration and probation service notifies the victim or the civil party, directly or through their lawyer, of the date on which probation ends.

This notice is not, however, sent where the victim or civil party has made it known that he or she does not wish to be notified of the arrangements for serving the sentence.

The arrangements for applying this article shall be specified by decree.

Article 745

Lorsque le condamné à une peine d’emprisonnement assortie du sursis probatoire doit satisfaire à l’obligation de s’abstenir de paraître dans un lieu ou une zone spécialement désigné, afin d’éviter un contact avec la victime ou la partie civile, ou à l’obligation de s’abstenir d’entrer en relation avec la victime ou la partie civile, prévues aux 9°,13° et 18°bis de l’article 132-45 du code pénal, le juge de l’application des peines ou le service pénitentiaire d’insertion et de probation avise la victime ou la partie civile, directement ou par l’intermédiaire de son avocat, de la date de fin de la mise à l’épreuve.

Cet avis n’est toutefois pas adressé lorsque la victime ou la partie civile a fait connaître qu’elle ne souhaitait pas être avisée des modalités d’exécution de la peine.

Les modalités d’application du présent article sont précisées par décret.
