Article 764-15 of the French Code of Criminal Procedure

The French judicial authorities shall once again have jurisdiction, at the initiative of the executing State, in the event of non-compliance with the obligations or injunctions mentioned in the sentence or probation decision, to pronounce the revocation of the suspension of enforcement of the sentence or conditional release or to pronounce and enforce a custodial sentence in cases where the executing State has declared to the General Secretariat of the Council of the European Union that it refuses to exercise such jurisdiction.

The Public Prosecutor shall inform the competent authority of the executing State without delay of any revocation of the suspension of enforcement of the sentence or of conditional release, of the imposition of a custodial sentence or measure involving deprivation of liberty on account of non-compliance with an alternative measure or penalty, or of any decision to terminate the alternative measure or penalty.

Article 764-15

Les autorités judiciaires françaises redeviennent compétentes, à l’initiative de l’Etat d’exécution, en cas de non-respect des obligations ou des injonctions mentionnées dans la condamnation ou dans la décision de probation, pour prononcer la révocation du sursis à l’exécution de la condamnation ou de la libération conditionnelle ou prononcer et mettre à exécution une peine privative de liberté dans les cas pour lesquels l’Etat d’exécution a déclaré au secrétariat général du Conseil de l’Union européenne qu’il refuse d’exercer cette compétence.

Le ministère public informe sans délai l’autorité compétente de l’Etat d’exécution de toute révocation du sursis à exécution de la condamnation ou de la libération conditionnelle, du prononcé d’une peine ou d’une mesure privative de liberté en raison du non-respect d’une mesure ou d’une peine de substitution, ou de toute décision d’extinction de la mesure ou de la peine de substitution.
