Article 764-25 of the French Code of Criminal Procedure

Enforcement of the sentencing decision may be refused in the following cases:

1° The duration of the alternative penalty or probation measure is less than six months at the date of receipt of the certificate;

2° The conviction or decision is based on offences committed wholly, mainly or for the most part on the territory of the Republic or in a place treated as such;

3° The conviction relates to offences for which the convicted person has already been finally judged by the court of a State that is not a member of the European Union, provided that the sentence has been enforced, is being enforced or can no longer be enforced under the legislation of that State.

Article 764-25

L’exécution de la décision de condamnation peut être refusée dans les cas suivants :

1° La durée de la peine de substitution ou de la mesure de probation est inférieure à six mois à la date de réception du certificat ;

2° La condamnation ou la décision est fondée sur des infractions commises en totalité, en majeure partie ou pour l’essentiel sur le territoire de la République ou en un lieu assimilé ;

3° La décision de condamnation porte sur des infractions pour lesquelles la personne condamnée a déjà été jugée définitivement par la juridiction d’un Etat non membre de l’Union européenne, à condition que la peine ait été exécutée, soit en cours d’exécution ou ne puisse plus être mise à exécution selon la législation de cet Etat.
