Article 803-5 of the French Code of Criminal Procedure

For the application of the right of a suspected or accused person, provided for by III of Preliminary Article, to an interpreter or a translation, the present article shall apply.

If there is any doubt as to the ability of the suspected or accused person to understand the French language, the authority conducting the hearing or before which that person appears shall verify that the person speaks and understands that language.

Exceptionally, an oral translation or an oral summary may be made of the essential documents that must be handed over or notified to the person pursuant to this code.

The procedures for applying this article shall be specified by decree, which shall define in particular the essential documents that must be translated.

Article 803-5

Pour l’application du droit d’une personne suspectée ou poursuivie, prévu par le III de l’article préliminaire, à un interprète ou à une traduction, il est fait application du présent article.

S’il existe un doute sur la capacité de la personne suspectée ou poursuivie à comprendre la langue française, l’autorité qui procède à son audition ou devant laquelle cette personne comparaît vérifie que la personne parle et comprend cette langue.

A titre exceptionnel, il peut être effectué une traduction orale ou un résumé oral des pièces essentielles qui doivent lui être remises ou notifiées en application du présent code.

Les modalités d’application du présent article sont précisées par décret, qui définit notamment les pièces essentielles devant faire l’objet d’une traduction.
