Article 90 of the French Code of Criminal Procedure

If the investigating judge does not have jurisdiction under Article 52, it shall, after hearing the Public Prosecutor’s case, make an order referring the civil party to such court as it sees fit.

Dans le cas où le juge d’instruction n’est pas compétent aux termes de l’article 52, il rend, après réquisitions du ministère public, une ordonnance renvoyant la partie civile à se pourvoir devant telle juridiction qu’il appartiendra.
