Article 972-1 of the French Code of civil procedure

Where the right of appeal is open to the public prosecutor, the right to lodge a main appeal belongs to the public prosecutor and the public prosecutor.

The documents of the proceedings before the court of appeal intended for the public prosecutor are notified to the public prosecutor at the court of appeal before which the appeal is lodged.

Lorsque la voie de l’appel est ouverte au ministère public, la faculté de former un appel principal appartient au procureur de la République et au procureur général.


Les actes de la procédure devant la cour d’appel destinés au ministère public sont notifiés au procureur général près la cour d’appel devant laquelle l’appel est formé.
