Article A212-215 of the French Sports Code

In application of the provisions of articles R. 212-88 and R. 212-92, nationals of a Member State of the European Union or a party to the Agreement on the European Economic Area who wish to provide caving supervision, instruction, teaching or training under the freedom of establishment or the freedom to provide services must declare themselves to the Prefect of the Isère department.

The Prefect checks that the application is admissible and requests the following three opinions:

-the opinion of the Rhône-Alpes sports resources, expertise and performance centre;

-the opinion of the most representative professional organisation;

-the opinion of the French Speleology Federation.

The opinion requested is sent to the Prefect of the Isère department within eight working days. Failing this, the opinion is deemed favourable.

En application des dispositions des articles R. 212-88 et R. 212-92, les ressortissants d’un Etat membre de l’Union européenne ou partie à l’accord sur l’Espace économique européen qui souhaitent assurer l’encadrement, l’animation, l’enseignement ou l’entraînement de la spéléologie dans le cadre de la liberté d’établissement ou de la libre prestation de services se déclarent au préfet du département de l’Isère.

Ce dernier s’assure de leur recevabilité et sollicite les trois avis suivants :

-l’avis du centre de ressources, d’expertise et de performance sportive de Rhône-Alpes ;

-l’avis de l’organisation professionnelle la plus représentative ;

-l’avis de la Fédération française de spéléologie.

L’avis sollicité est transmis dans le délai de huit jours ouvrés au préfet du département de l’Isère. A défaut, l’avis est réputé favorable.
