Article A37-17 of the French Code of Criminal Procedure

When a specific request for exoneration form is sent to the offender, it includes the following information:

-the remedies available to the offender and the procedures for exercising them;

-information on the examination of the request and the action likely to be taken on it.

When the offence being prosecuted is one of those mentioned in Article L. 121-3 of the Highway Code, the form details each of the cases for requesting exoneration and specifies whether or not a prior deposit is payable. A deposit card is inserted at the bottom of the front of the form when this document is sent to the holder of the registration certificate.

Lorsqu’un formulaire spécifique de requête en exonération est adressé au contrevenant, il comprend les mentions suivantes :

-les voies de recours ouvertes au contrevenant et les modalités de leur exercice ;

-une information sur l’examen de la requête et les suites susceptibles de lui être données.

Lorsque la contravention poursuivie est l’une de celles mentionnées à l’article L. 121-3 du code de la route, le formulaire détaille chacun des cas de requête en exonération et précise si une consignation préalable est exigible ou non. Une carte de consignation est insérée au bas du recto du formulaire lorsque ce document est adressé au titulaire du certificat d’immatriculation.
