Article A37-4 of the French Code of Criminal Procedure

The characteristics of the notice of offence referred to in Article A. 37-1 are as follows:

I.-On the left-hand side, details are given of the issuing department, the nature, place and date of the offence, as well as the references of the texts punishing the said offence and, where applicable, details are given of the vehicle’s identification and the obligation to exchange the driving licence.

II.-On the right-hand side is a space intended to inform the offender of his or her rights and containing the following information:

You are informed that:

1. You may exercise a right of access and rectification when information concerning you is subject to automated processing (art. 39 et 40 de la loi n° 78-17 du 6 janvier 1978) to:

the officer of the public prosecutor’s office at the local court or the police court;

the competent public accountant when the latter is responsible for collecting the increased fixed fine.

2. Payment of the fixed fine entails recognition of the reality of the offence;

3. If the heading “Obligation to exchange your driving licence” has been ticked, you are obliged to exchange your driving licence issued by a State of the European Union or the European Economic Area with the prefectural service of your place of residence.

4. You may exercise a right of access to information concerning your driving licence with the prefectural service of your place of residence.

III.-A space is reserved, in the event of non-payment by cheque, for affixing the part of the fine stamp to be retained.

Les caractéristiques de l’avis de contravention mentionné à l’article A. 37-1 sont les suivantes :

I.-Sur la partie gauche sont portées les mentions relatives au service verbalisateur, à la nature, au lieu et à la date de la contravention ainsi que les références des textes réprimant ladite contravention et, le cas échéant, sont précisés les éléments d’identification du véhicule et l’obligation de procéder à l’échange du permis de conduire.

II.-Sur la partie droite figure un emplacement destiné à informer le contrevenant de ses droits et comportant les mentions suivantes :

Vous êtes informé(e) que :

1. Vous pouvez exercer un droit d’accès et de rectification lorsque les renseignements vous concernant font l’objet d’un traitement automatisé (art. 39 et 40 de la loi n° 78-17 du 6 janvier 1978) auprès :

-de l’officier du ministère public près la juridiction de proximité ou le tribunal de police ;

-du comptable public compétent lorsque celui-ci est chargé du recouvrement de l’amende forfaitaire majorée.

2. Le paiement de l’amende forfaitaire entraîne reconnaissance de la réalité de l’infraction ;

3. Si la rubrique ” Obligation d’échange du permis de conduire ” a été cochée, vous êtes dans l’obligation d’effectuer auprès du service préfectoral de votre domicile l’échange de votre permis de conduire délivré par un Etat de l’Union européenne ou de l’Espace économique européen.

4. Vous pouvez exercer, auprès du service préfectoral de votre domicile, un droit d’accès aux informations concernant votre permis de conduire.

III.-Un emplacement est destiné, en cas de non-paiement par chèque, à l’apposition de la partie à conserver du timbre-amende.
