Article D111-10 of the French Consumer Code

For the application of the provisions of the ninth paragraph of Article L. 111-7, the provision of online information allowing the comparison of prices and characteristics of goods and services means the activity of sites comparing goods and services and allowing, where applicable, access to sites selling these goods or providing these services.

Also covered by the provisions of the ninth paragraph of Article L. 111-7 are distance selling sites which offer, on a principal basis, the comparison of goods or services, sold by themselves or by third parties.

Any person who, for their commercial activity by electronic means, uses the terms “comparator” or “comparison”, is carrying out a comparison activity within the meaning of the ninth paragraph of Article L. 111-7.

Pour l’application des dispositions du neuvième alinéa de l’article L. 111-7, la fourniture d’informations en ligne permettant la comparaison des prix et des caractéristiques de biens et de services s’entend de l’activité de sites comparant des biens et des services et permettant, le cas échéant, l’accès aux sites de vente de ces biens ou de fourniture de ces services.


Relèvent également des dispositions du neuvième alinéa de l’article L. 111-7, les sites de vente à distance qui proposent, à titre principal, la comparaison de biens ou de services, vendus par eux-mêmes ou par des tiers.


Toute personne qui, pour son activité commerciale par voie électronique, utilise les termes de ” comparateur ” ou de ” comparaison “, exerce une activité de comparaison au sens du neuvième alinéa de l’article L. 111-7.
