Article D116 of the French Code of Criminal Procedure

For the application of the provisions of article 721 relating to sentence reductions, the Sentence Enforcement Commission examines the sentenced person’s situation at least once a year, even ex officio in the absence of a request made by the sentenced person in accordance with the provisions of article D. 49-11.

In the event of imprisonment under the pre-trial detention regime and if the duration is at least one year, the sentenced person’s situation is examined by the Sentence Enforcement Commission within a period of one year.
In the event of imprisonment under the pre-trial detention regime and if the duration thereof is at least one year, the situation of the sentenced person is examined by the Sentence Enforcement Commission within two months of the date on which the sentence became final.

Pour l’application des dispositions de l’article 721 relatives aux réductions de peine, la commission de l’application des peines examine la situation du condamné au moins une fois par an, même d’office en l’absence de demande formée par celui-ci conformément aux dispositions de l’article D. 49-11.


En cas d’incarcération subie sous le régime de la détention provisoire et si la durée en est d’au moins une année, la situation du condamné est examinée par la commission de l’application des peines dans un délai de deux mois à compter de la date à laquelle la condamnation est devenue définitive.
