Article D122-3 of the French Consumer Code

I.-When all the dishes offered by the professional are “home-made”, the words “home-made” or “home-made” or the logo defined by order of the Minister for Trade may appear in a single place visible to all consumers. This provision applies automatically to master restaurant owners.

II.-The indications or logo appear, where appropriate, for each of the dishes on the media used to present them as well as on the professional’s other marketing media, particularly online.

III.-A dish composed exclusively of products mentioned in article D. 122-1-II may not be presented as “home-made”.

I.-Lorsque l’ensemble des plats proposés par le professionnel est “ fait maison ”, la mention “ fait maison ” ou “ maison ” ou le logo défini par arrêté du ministre chargé du commerce peuvent figurer à un endroit unique visible par tous les consommateurs. Cette disposition s’applique de plein droit aux maîtres-restaurateurs.



II.-Les mentions ou le logo figurent, le cas échéant, pour chacun des plats sur les supports utilisés pour les présenter ainsi que sur les autres supports de commercialisation du professionnel, notamment en ligne.



III.-Un plat composé exclusivement de produits mentionnés à l’article D. 122-1-II ne peut être présenté comme “ fait maison ”.
