Article D1233-51 of the French Labour Code

When a company has concluded an agreement in application of the first paragraph of article L. 6331-10, the employer pays to the skills operator, designated by the branch agreement to which the company belongs, all or part of the amount paid by the body in application of article D. 1233-49, within the limit of the amount of the contribution defined in article L. 6331-10, in order to finance the training measures provided for in article L. 1233-65.

In the event that a company is unable to make this payment, the amount will be paid to the skills operator designated by the branch agreement to which the company belongs.

For the application of article R. 6331-13, this payment is taken into account in the total expenditure actually devoted by the employer to financing the personal training account of its employees.

Article D1233-51

Lorsqu’une entreprise a conclu un accord en application du premier alinéa de l’article L. 6331-10, l’employeur verse à l’ opérateur de compétences, désigné par l’accord de branche dont l’entreprise relève, tout ou partie du montant pris en charge par l’organisme en application de l’article D. 1233-49, dans la limite du montant de la contribution définie à l’article L. 6331-10, afin de financer les mesures de formation prévues à l’article L. 1233-65.

Dans l’hypothèse où une entreprise ne peut procéder à ce versement, ce montant reste à la charge de l’ opérateur de compétences désigné par l’accord de branche dont l’entreprise relève.

Pour l’application de l’article R. 6331-13, ce versement est pris en compte dans le total des dépenses effectivement consacrées par l’employeur au financement du compte personnel de formation de ses salariés.
