Article D1237-9 of the French Labour Code

The period provided for in article L. 1237-19-4 begins on receipt of the complete file by the Regional Director of Companies, Competition, Consumption, Labour and Employment.

The file is complete when it includes the agreement provided for in article L. 1237-19, as well as the information required to verify the legality of the conditions under which it was concluded and, where applicable, the effective implementation of the information of the social and economic committee provided for in 1° of article L. 1237-19-1.

If there is no social and economic committee as a result of a failure to act recorded under the conditions set out in article L. 2314-9, the employer attaches the official report recording this failure to the application for validation.

The Regional Director of Companies, Competition, Consumption, Labour and Employment informs the employer, the signatories of the agreement and, where applicable, the Social and Economic Committee, without delay and by any means that can be relied upon to provide a date certain, that the file is complete.

Within the period provided for in article L. 1237-19-4, the administrative authority may request, where appropriate, any additional supporting evidence from the employer to enable it to carry out the checks provided for in article L. 1237-19-3.

Le délai prévu à l’article L. 1237-19-4 court à compter de la réception du dossier complet par le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi.


Le dossier est complet lorsqu’il comprend l’accord prévu à l’article L. 1237-19, ainsi que les informations permettant de vérifier la régularité des conditions dans lesquelles il a été conclu et, le cas échéant, la mise en œuvre effective de l’information du comité social et économique prévue au 1° de l’article L. 1237-19-1.


En cas d’absence de comité social et économique par suite d’une carence constatée dans les conditions prévues à l’article L. 2314-9, l’employeur joint à la demande de validation le procès-verbal constatant cette carence.


Le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi informe sans délai et par tout moyen permettant de conférer une date certaine l’employeur, les signataires de l’accord et, le cas échéant, le comité social et économique que le dossier est complet.


Dans le délai prévu à l’article L. 1237-19-4, l’autorité administrative peut demander, le cas échéant, tout élément justificatif complémentaire à l’employeur afin de lui permettre d’opérer le contrôle prévu à l’article L. 1237-19-3.
