Article D1272-1 of the French Labour Code

The employee identification declaration referred to in article D. 133-13-1 of the Social Security Code includes the following information:

1° Information relating to the employee provided for in 2° and 3° of article R. 1221-1, relating to the declaration prior to recruitment;

2° Information relating to the job:

a) The nature of the employment contract: open-ended contract or fixed-term contract, with, in the latter case, an indication of the reason for use and the date on which the contract ends;

b) The duration of the work ;

c) The length of the trial period;

d) The job category, the nature of the job and, where applicable, the job level (hierarchical level and coefficient);

e) The title of the applicable collective agreement, if any;

f) The amount of remuneration and its various components, including, if applicable, bonuses and additional remuneration;

g) The particulars of the employment contract, if any;

h) The rate of contribution due in respect of accidents at work and occupational illnesses if several rates are applicable in the establishment;

i) Any deductions from the contribution base or rate;

j) The contribution rate for provident insurance, if it is specific to the employee;

k) Whether the employee is subject to transport contributions, if applicable;

l) Indication, where applicable, of a first recruitment in the establishment;

3° Signature of employer and employee.

A copy of the employee identification form is sent by the employer to the employee within the time limits specified in this code.

La déclaration d’identification du salarié mentionnée à l’ article D. 133-13-1 du code de la sécurité sociale d’identification du salarié comporte les mentions suivantes :

1° Mentions relatives au salarié prévues aux 2° et 3° de l’article R. 1221-1, relatif à la déclaration préalable à l’embauche ;

2° Mentions relatives à l’emploi :

a) La nature du contrat de travail : contrat à durée indéterminée ou à durée déterminée, avec, dans ce cas, indication du motif de recours et de la date de fin de contrat ;

b) La durée du travail ;

c) La durée de la période d’essai ;

d) La catégorie d’emploi, la nature de l’emploi et, le cas échéant, le niveau d’emploi (niveau hiérarchique et coefficient) ;

e) L’intitulé de la convention collective applicable, le cas échéant ;

f) Le montant de la rémunération et de ses différentes composantes, y compris, s’il en existe, les primes et accessoires de salaire ;

g) Les particularités du contrat de travail s’il y a lieu ;

h) Le taux de la cotisation due au titre des accidents du travail et des maladies professionnelles si plusieurs taux sont applicables dans l’établissement ;

i) La pratique éventuelle d’un abattement sur l’assiette ou le taux des cotisations ;

j) Le taux de cotisation pour la prévoyance, s’il est spécifique au salarié ;

k) L’assujettissement au versement de transport s’il y a lieu ;

l) L’indication, le cas échéant, d’une première embauche dans l’établissement ;

3° Signature de l’employeur et du salarié.

Une copie du volet d’identification du salarié est transmise par l’employeur au salarié dans les délais prévus par le présent code.
