Article D1453-2-1 of the French Labour Code

The list of trade union representatives referred to in article L. 1453-4 is drawn up by the regional director of companies, competition, consumption, labour and employment, on the basis of proposals from the employers’ and employees’ organisations referred to in the same article. These organisations appoint trade union representatives at regional level on the basis of their experience of industrial relations and their knowledge of employment law.

Trade union representatives perform their duties free of charge.

They are entered on the list for the region in which they live or where they carry out their professional activity.

La liste des défenseurs syndicaux mentionnée à l’article L. 1453-4 est établie par le directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi, sur proposition des organisations d’employeurs et de salariés mentionnées au même article. Ces dernières désignent des défenseurs syndicaux au niveau régional en fonction de leur expérience des relations professionnelles et de leurs connaissances du droit social.


Les défenseurs syndicaux exercent leurs fonctions à titre gratuit.


Ils sont inscrits sur la liste de la région de leur domicile ou du lieu d’exercice de leur activité professionnelle.
