Article D15-4 of the French Code of Criminal Procedure

The minutes of the acts carried out in execution of requisitions made pursuant to the third paragraph of Article 41 shall be returned directly to the instructing public prosecutor.

When the case is referred to the Investigating Chamber or the Criminal Appeals Chamber of the Court of Appeal, the Public Prosecutor may, in accordance with the provisions of the eighth paragraph of Article 41, issue requisitions for the purposes of carrying out an investigation into the material, family and social situation of the person being prosecuted or verifying the material feasibility of certain sentences or sentence adjustments.

Les procès-verbaux des actes accomplis en exécution des réquisitions prises en application du troisième alinéa de l’article 41 sont directement retournés au procureur de la République mandant.

Lorsque la chambre de l’instruction ou la chambre des appels correctionnels de la cour d’appel est saisie, le procureur général peut, conformément aux dispositions du huitième alinéa de l’article 41, prendre des réquisitions aux fins de réalisation d’une enquête sur la situation matérielle, familiale et sociale de la personne poursuivie ou de la vérification de la faisabilité matérielle de certaines peines ou aménagements de peine.
