The professional trade unions of employees or employers and their associations, and the associations of employees or employers mentioned in article L. 2135-1 whose resources within the meaning of article D. 2135-9 are less than 230,000 euros at the close of a financial year ensure the publication of their accounts and, in the case of professional trade unions of employers, their unions and employers’ associations wishing to establish their representativeness on the basis of Title V of Book I of Part Two of the present Code, of the auditor’s report within three months of their approval by the statutory deliberative body either under the conditions provided for in article D. 2135-7, or by publication on their website or, in the absence of a website, in the regional directorate for companies, competition, consumption, labour and employment. To this end, they shall send their accounts, where appropriate by electronic means, together with, in the case of professional employers’ trade unions, their unions and employers’ associations wishing to establish their representativeness on the basis of Title V of Book I of Part Two of this Code, the auditor’s report or the book referred to in Article D. 2135-4 to the regional directorate for companies, competition, consumption, labour and employment in whose area their registered office is located.
These annual accounts may be freely consulted.
However, the annual accounts of professional trade unions of employees or employers and their unions, and associations of employees or employers mentioned in article L. 2135-1 whose resources, within the meaning of article D. 2135-9, are less than 23,000 euros at the close of a financial year, may only be consulted on condition that such consultation is not likely to infringe on the privacy of their members.
The Regional Director for Business, Competition, Consumer Affairs, Labour and Employment shall render anonymous any information enabling members to be identified before communicating the documents mentioned in the first paragraph.
