Article D2315-1 of the French Labour Code

Where the Social and Economic Committee meets by videoconference, the technical equipment used guarantees the identification of committee members and their effective participation, by ensuring the continuous and simultaneous transmission of sound and images of the proceedings.

The provisions of the first paragraph do not preclude the holding of adjournments.

When a secret ballot is held in accordance with the provisions of article L. 2315-4, the voting system must ensure that the identity of the voter cannot at any time be linked to the expression of his vote. When this vote is organised by electronic means, the system chosen must ensure the confidentiality of the data transmitted as well as the security of the addressing of the means of authentication, the counting of votes and the recording and counting of votes.

Lorsque le comité social et économique est réuni en visioconférence, le dispositif technique mis en œuvre garantit l’identification des membres du comité et leur participation effective, en assurant la retransmission continue et simultanée du son et de l’image des délibérations.


Les dispositions prévues au premier alinéa ne font pas obstacle à la tenue de suspensions de séance.


Lorsqu’il est procédé à un vote à bulletin secret en application des dispositions de l’article L. 2315-4, le dispositif de vote garantit que l’identité de l’électeur ne peut à aucun moment être mise en relation avec l’expression de son vote. Lorsque ce vote est organisé par voie électronique, le système retenu doit assurer la confidentialité des données transmises ainsi que la sécurité de l’adressage des moyens d’authentification, de l’émargement, de l’enregistrement et du dépouillement des votes.
