Article D2573-13-2 of the French General Code of Local Authorities

When, as a result of the start of one or more construction programmes, the population of a municipality has undergone a variation in accordance with the formula set out in article R. 2573-13-1, an order of the Minister for Overseas France, issued after consultation with the Minister for the Economy, may decide that a fictitious population corresponding to four times the number of dwellings under construction, i.e. located in a building whose foundations have begun to be poured as stated in article D. 2573-13-1 for the calculation of State grants and subsidies to local authorities and for any distribution of common funds.

Lorsque, par suite de la mise en chantier d’un ou plusieurs programmes de construction, la population d’une commune a subi une variation répondant à la formule énoncée à l’article R. 2573-13-1, un arrêté du ministre chargé de l’outre-mer, pris après avis du ministre chargé de l’économie, peut décider qu’il est ajouté à la population totale de cette commune une population fictive correspondant à quatre fois le nombre de logements en chantier, c’est-à-dire situés dans un immeuble dont les fondations ont commencé à être coulées ainsi qu’il est dit à l’article D. 2573-13-1 pour le calcul des dotations et subventions de l’Etat aux collectivités territoriales et pour toute répartition de fonds commun.
