Article D2573-21 of the French General Code of Local Authorities

I. – The first three paragraphs of article D. 2224-1, the first paragraph of article D. 2224-2, the first four paragraphs of article D. 2224-3, the first paragraph of article D. 2224-4 and the first two paragraphs of article D. 2224-5 are applicable to the communes of French Polynesia subject to the adaptations provided for in II to V.

II. – For the application of article D. 2224-1:

1° In the first paragraph, the words: “as well as for the public service for the prevention and management of household and similar waste” are deleted;

2° In the second and third paragraphs, the words: “as well as for the public service for the prevention and management of household and similar waste” are deleted;

3° In the third paragraph, the words: “Annexes V, VI and XIII of this Code” are replaced by the words: “an order of the High Commissioner of the Republic”.

III. – For the application of Article D. 2224-2, in the first paragraph, the words: “Annexes V and VI of this Code” are replaced by the words: “an order of the High Commissioner of the Republic”.

IV. – For the application of Article D. 2224-3:

1° In the second paragraph, the words: “or the prevention and management of household and similar waste” are deleted;

2° In the fourth paragraph, the words: “mentioned in Annexes V and VI of this code” are replaced by the words: “defined by an order of the High Commissioner of the Republic”.

V. – For the application of Article D. 2224-5, the words: “to the Prefect” are replaced by the words: “to the High Commissioner”

I. – Les trois premiers alinéas de l’article D. 2224-1, le premier alinéa de l’article D. 2224-2, les quatre premiers alinéas de l’article D. 2224-3, le premier alinéa de l’article D. 2224-4 et les deux premiers alinéas de l’article D. 2224-5 sont applicables aux communes de Polynésie française sous réserve des adaptations prévues aux II à V.

2° Aux deuxième et troisième alinéas, les mots : ” ainsi que pour le service public de prévention et de gestion des déchets ménagers et assimilés ” sont supprimés ;

3° Au troisième alinéa, les mots : ” les annexes V, VI et XIII du présent code ” sont remplacés par les mots : ” un arrêté du haut-commissaire de la République “.

III. – Pour l’application de l’article D. 2224-2, au premier alinéa, les mots : ” les annexes V et VI du présent code ” sont remplacés par les mots : ” un arrêté du haut-commissaire de la République “.

IV. – Pour l’application de l’article D. 2224-3 :

1° Au deuxième alinéa, les mots : ” ou de prévention et de gestion des déchets ménagers et assimilés ” sont supprimés ;

2° Au quatrième alinéa, les mots : ” mentionnés à l’annexe V et VI du présent code ” sont remplacés par les mots : ” définis par un arrêté du haut-commissaire de la République “.

V. – Pour l’application de l’article D. 2224-5, les mots : ” au préfet ” sont remplacés par les mots : ” au haut-commissaire “
