Article D3844-2 of the French Public Health Code

For the application of Book II :

1° The powers vested in the Prefect are exercised by the representative of the State;

2° The powers vested in the judicial court, its president or its registry are vested in the court of first instance, its president or its registry;

3° References to the departmental psychiatric care commission are replaced by references to the psychiatric care commission;

4° References to an establishment mentioned in article L. 3222-1 are replaced by references to an establishment authorised to treat people suffering from mental disorders, in accordance with locally applicable regulations.

Article D3844-2

Pour l’application du livre II :

1° Les attributions dévolues au préfet sont exercées par le représentant de l’Etat ;

2° Les attributions dévolues au tribunal judiciaire, à son président ou à son greffe sont attribuées au tribunal de première instance, à son président ou à son greffe ;

3° Les références à la commission départementale des soins psychiatriques sont remplacées par des références à la commission des soins psychiatriques ;

4° Les références à un établissement mentionné à l’article L. 3222-1 sont remplacées par des références à un établissement habilité à soigner les personnes atteintes de troubles mentaux, conformément à la réglementation applicable localement.
