Article D4622-31 of the French Labour Code

The inter-company committee or the inspection commission is consulted on the organisation and operation of the occupational health and safety service, in particular on :

1° The budget and the implementation of the budget of the occupational health and prevention service;

2° Changes to the geographical or professional remit of the Occupational Health and Prevention Service;

3° The creation, deletion or modification of sectors;

4° The creation and abolition of posts for occupational health physicians, occupational risk prevention workers or nurses;

5° The recruitment of occupational physicians on fixed-term contracts;

6° The appointment, change of assignment, dismissal, contractual termination of the employment contract, termination of the fixed-term employment contract in the cases provided for in article L. 4623-5-1 and the transfer of an occupational health physician;

7° The dismissal of an occupational risk prevention worker or nurse.

The committee or commission may also be consulted on any matter within its remit.

Le comité interentreprises ou la commission de contrôle est consulté sur l’organisation et le fonctionnement du service de prévention et de santé au travail, notamment sur :

1° Le budget ainsi que l’exécution du budget du service de prévention et de santé au travail ;

2° La modification de la compétence géographique ou professionnelle du service de prévention et de santé au travail ;

3° Les créations, suppressions ou modifications de secteurs ;

4° Les créations et suppressions d’emploi de médecin du travail, d’intervenant en prévention des risques professionnels ou d’infirmier ;

5° Les recrutements de médecins du travail en contrat de travail à durée déterminée ;

6° La nomination, le changement d’affectation, le licenciement, la rupture conventionnelle du contrat de travail, la rupture du contrat de travail à durée déterminée dans les cas prévus à l’article L. 4623-5-1 et le transfert d’un médecin du travail ;

7° Le licenciement d’un intervenant en prévention des risques professionnels ou d’un infirmier.

Le comité ou la commission peut en outre être consulté sur toute question relevant de sa compétence.
