Article D47-32 of the French Code of Criminal Procedure

When it issues a prohibition pursuant to the provisions of Article 706-136, the investigating chamber or the trial court may order, either in its decision or in a subsequent decision, that the declaration of lack of criminal responsibility on grounds of mental disorder will not be mentioned in bulletin no. 2 of the criminal record in accordance with the provisions of Article 775-1.

Lorsqu’elle prononce une interdiction en application des dispositions de l’article 706-136, la chambre de l’instruction ou la juridiction de jugement peut ordonner, soit dans sa décision, soit dans une décision ultérieure, que la déclaration d’irresponsabilité pénale pour cause de trouble mental ne sera pas mentionnée au bulletin n° 2 du casier judiciaire conformément aux dispositions de l’article 775-1.
