Notwithstanding the provisions of 1° of article D. 48-23, the ground for refusal based on the absence of criminality under French law is not enforceable where the financial penalty relates to an offence which, under the law of the issuing State, falls within one of the categories of offences mentioned in Article 694-32 or in one of the following categories:
-driving contrary to the rules relating to road traffic, breaches of the rules on driving time and rest periods and those relating to the transport of dangerous goods;
-contraband smuggling;
-infringement of intellectual property rights;
-threats and acts of violence against persons ;
-destruction, damage or deterioration;
-theft;
-infractions established by the issuing State and covered by enforcement obligations arising from instruments adopted in accordance with the Treaty establishing the European Community or Title VI of the Treaty on European Union.
