Article D48-24 of the French Code of Criminal Procedure

Notwithstanding the provisions of 1° of article D. 48-23, the ground for refusal based on the absence of criminality under French law is not enforceable where the financial penalty relates to an offence which, under the law of the issuing State, falls within one of the categories of offences mentioned in Article 694-32 or in one of the following categories:

-driving contrary to the rules relating to road traffic, breaches of the rules on driving time and rest periods and those relating to the transport of dangerous goods;

-contraband smuggling;

-infringement of intellectual property rights;

-threats and acts of violence against persons ;

-destruction, damage or deterioration;

-theft;

-infractions established by the issuing State and covered by enforcement obligations arising from instruments adopted in accordance with the Treaty establishing the European Community or Title VI of the Treaty on European Union.

Article D48-24

Nonobstant les dispositions du 1° de l’article D. 48-23, le motif de refus fondé sur l’absence d’incrimination en droit français n’est pas opposable lorsque la sanction pécuniaire concerne une infraction qui, en vertu de la loi de l’Etat d’émission, entre dans l’une des catégories d’infractions mentionnées à l’article 694-32 ou dans l’une des catégories suivantes :

-conduite contraire aux règles relatives à la circulation routière, infractions aux règles en matière de temps de conduite et de repos et à celles relatives au transport de marchandises dangereuses ;

-contrebande de marchandises ;

-atteinte aux droits de propriété intellectuelle ;

-menaces et actes de violence contre des personnes ;

-destruction, dégradation ou détérioration ;

-vol ;

-infractions établies par l’Etat d’émission et couvertes par les obligations d’exécution découlant des instruments adoptés conformément au traité instituant la Communauté européenne ou au titre VI du traité sur l’Union européenne.
