An individual file concerning each convicted offender monitored by this magistrate is kept at the registry of the sentence enforcement judge.
This file includes copies of the documents from the proceedings leading to his sentence and which are necessary for the enforcement of the sentence.
It also includes reports drawn up and decisions taken during the enforcement of the sentence.
The opinion of the prison administration representative provided for in articles 712-6 and 712-7 is added to the file in the form of a report summarising the opinions of the various competent prison services.
This file may be consulted by the sentenced person’s lawyer, subject to the requirements of the proper functioning of the office of the sentence enforcement judge. The sentenced person’s lawyer may obtain a copy of all or part of the documents in the file in accordance with the provisions of Article R. 165 provides that the first copy issued is free of charge. Subsequent copies are issued at the convicted person’s expense, unless the convicted person has obtained legal aid.
The public prosecutor may consult this file or request its communication.
Where a change in the sentenced person’s situation renders him or her competent, pursuant to the provisions of article 712-10, a sentencing judge other than the one initially responsible, the latter shall forward the file to the judge newly competent to monitor the convicted offender and shall notify the public prosecutor’s office of the place of conviction.
