Article D49-35 of the French Code of Criminal Procedure

The sentence enforcement judge who, in the case provided for by Article 712-8, considers modifying a measure on its own initiative or receives a request for modification from the sentenced person, communicates the case file to the public prosecutor for an opinion, before ruling by reasoned order or, if the public prosecutor has so requested, after an adversarial debate, in accordance with the provisions of this article.

When the sentence enforcement judge takes up the case of his own motion or when it is referred to him by the public prosecutor and no adversarial hearing is held, he shall first obtain the opinion of the sentenced person or have it obtained.

Le juge de l’application des peines qui, dans le cas prévu par l’article 712-8, envisage d’office de modifier une mesure ou est saisi d’une demande de modification formée par le condamné, communique le dossier pour avis au procureur de la République, avant de statuer par ordonnance motivée ou, si le procureur en a fait la demande, après débat contradictoire, conformément aux dispositions de cet article.

Lorsque le juge de l’application des peines se saisit d’office ou est saisi par le procureur de la République et qu’il n’est pas procédé à un débat contradictoire, il recueille ou fait recueillir préalablement l’avis du condamné.
