Article D49-65-1 of the French Code of Criminal Procedure

A victim or civil party who, in accordance with the provisions of the last paragraph of Article 712-16-2, wishes to be informed of the release of a person convicted of an offence referred to in Article 706-47, on the expiry date of his sentence, sends this request by registered letter with acknowledgement of receipt to the public prosecutor or the public prosecutor of the convicting court. This request is forwarded by the public prosecutor to the sentence enforcement judge responsible for the convicted offender to be filed in the “victim” section of the individual file provided for in article D. 49-29.

The person may specify in their request that they wish to be informed via their lawyer.

La victime ou la partie civile qui, conformément aux dispositions du dernier alinéa de l’article 712-16-2, souhaite être informée de la libération d’une personne condamnée pour une infraction visée à l’article 706-47, à la date d’échéance de sa peine, adresse cette demande par lettre recommandée avec accusé de réception au procureur de la République ou au procureur général de la juridiction de condamnation. Cette demande est transmise par le ministère public au juge de l’application des peines dont relève le condamné pour être classée dans la cote ” victime ” du dossier individuel prévu par l’article D. 49-29.



La personne peut préciser dans sa demande qu’elle souhaite être informée par l’intermédiaire de son avocat.
