Article D5132-43-9 of the French Labour Code

When an employer plans to conclude employment contracts that derogate, for all of its eligible employees, from the minimum weekly working time of twenty hours, it must provide the Prefect with:

1° A document designed to establish that the integration workshop or site has a project for enhanced support for employees with particularly serious common difficulties that justifies recourse to this derogation;

2° Any document intended to establish the criteria for selecting employees for the specific support programme that it plans to implement during the derogation period.

Lorsqu’un employeur envisage de conclure des contrats de travail dérogeant, pour tous ses salariés éligibles, à la durée hebdomadaire minimale de vingt heures, il fournit au préfet :


1° Un document visant à établir que l’atelier et chantier d’insertion porte un projet d’accompagnement renforcé des salariés présentant des difficultés communes particulièrement importantes justifiant le recours à cette dérogation ;


2° Tout document visant à établir les critères de sélection des salariés dans le programme d’accompagnement spécifique qu’il envisage de mettre en œuvre pendant la période dérogatoire.
