Applications for debt remission are examined by a commission comprising the heads of financial services and representatives of the bodies and institutions concerned.
The composition and operating conditions of this commission are set by the decree no. 2007-686 of 4 May 2007instituting in each department a commission of heads of financial services and representatives of social security and unemployment insurance bodies to examine the situation of late debtors.
The chairman of the committee collects the decisions of the administrations, bodies and institutions represented and ensures that they are notified. When favourable, the notification specifies the amounts of public debt waivers as well as the conditions attached thereto with respect to private creditors. The chairman may delegate his signature to one of the members of the commission.
Failure to respond within two months of the date of receipt of all the information referred to in Articles D. 626-12 and D. 626-13 shall constitute a rejection decision.
