Article D6275-2 of the French Labour Code

On receipt of the contract, the departmental unit of the regional directorate for companies, competition, consumption, labour and employment checks that it meets the conditions laid down by :

1° Article L. 6211-1 on courses eligible for apprenticeship;

2° Articles L. 6222-1 to L. 6222-3 on the age of the apprentice;

3° Articles D. 6222-26 to D. 6222-33 on apprentice pay.

If it is found that at least one of these conditions has not been met, the apprenticeship contract is refused. The parties and the apprentice training centre are notified of this refusal. The notification must specify the reason for the refusal. It may be sent by electronic means.

A réception du contrat, l’unité départementale de la direction régionale des entreprises, de la concurrence, de la consommation, du travail et de l’emploi vérifie qu’il satisfait aux conditions posées par :


1° L’article L. 6211-1 relatif aux formations éligibles à l’apprentissage ;


2° Les articles L. 6222-1 à L. 6222-3 relatifs à l’âge de l’apprenti ;


3° Les articles D. 6222-26 à D. 6222-33 relatifs à la rémunération des apprentis.


S’il est constaté que l’une au moins de ces conditions n’est pas satisfaite, le dépôt du contrat d’apprentissage est refusé. Ce refus est notifié aux parties ainsi qu’au centre de formation d’apprentis. La notification précise le motif du refus. Elle peut être faite par voie dématérialisée.
