The Chairman of the Centre National du Cinéma et de l’Image Animée has the following prerogatives on behalf of the State:
1° He studies and participates in the drafting of legislative and regulatory texts relating to the cinema and other moving image arts and industries;
2° It lays down, where these so provide, the regulatory terms and conditions for the application of texts relating to the cinema and other arts and industries of the moving image;
3° It proposes any measure likely to contribute to the development and modernisation of the sectors concerned;
4° It participates in the preparation of regulations and the monitoring of professional negotiations relating to the obligations of production and broadcasting of cinematographic and audiovisual works to which publishers of audiovisual media services are subject and, more generally, to any question concerning audiovisual broadcasting, literary and artistic property and the social and fiscal regime of the professions and activities of the cinema and other arts and industries of the moving image;
5° It participates in the negotiation of international agreements relating to co-productions and exchanges in the fields of cinema and the other arts and moving image industries and is involved in preparing the French position in international negotiations in these fields;
6° It issues the authorisation required to operate a cinema, in accordance with articles L. 212-2 to L. 212-5 ;
7° It approves cinematographic entertainment establishments, in accordance with articles L. 212-14 to L. 212-17;
8° It registers the declarations made by operators of cinematographic establishments relating to the relocation of film screenings, in accordance with article L. 212-18;
9° It issues approval prior to the creation of film programming groups and agreements and approves programming commitments, in accordance with articles L. 212-19 to L. 212-26;
10° It issues prior authorisation for the introduction of cinema access formulas giving entitlement to multiple admissions, in accordance with articles L. 212-27 to L. 212-31;
11° It grants authorisation for the organisation of open-air film screenings, in accordance with article L. 214-6 ;
12° It registers the declaration of videogram publishers provided for in article L. 221-1 ;
13° It issues exemptions from the time limit for showing cinematographic works in videogram form, in accordance with article L. 231-1;
14° It issues the approvals provided for in articles 220 F, 220 X, 220 Z bis, 220 sexies, 220 terdecies and 220 quaterdecies of the General Tax Code, as well as the approval provided for in article 238 bis HF of the same code;
15° It authorises or commissions the agents of the Centre national du cinéma et de l’image animée mentioned in articles L. 115-16 and L. 411-1 and appoints those responsible for applying articles L. 331-2 and L. 331-19 of the French Intellectual Property Code;
16° It takes legal action relating to the prerogatives mentioned in 2° and 6° to 15°.
